City of Naperville Electric Utility - Notice of PURPA Proceeding

The City of Naperville Electric Utility will hold public proceedings to facilitate the consideration and determination of federal standards established by the Public Utility Regulatory Policy Act of 1978, as amended by the Energy Policy Act of 2005 and the Energy Independence and Security Act of 2007.

The public proceeding is held pursuant to Public Utility Regulatory Policies Act of 1978, 16 U.S.C § 2601 et seq., and particularly pursuant to 16 U.S.C §§ 2621, 2622, 2631, and 2632. The proceeding will be held on March 4, 2013, from 3 to 7 p.m. and March 19, 2013, from 10 a.m. to 4 p.m. in Council Chambers of the Naperville Municipal Center, 400 S. Eagle St., Naperville, IL 60540. The following federal standards will be considered at the proceedings:

  1. Net Metering
  2. Fuel Sources Standards
  3. Fossil Fuel Generation Efficiency Standards
  4. Interconnection Standards
  5. Smart Metering (with Time Based Rate Schedules)
  6. Integrated Resource Planning
  7. Rate Design Modifications
  8. Smart Grid Information

The proceedings will be governed by the “City of Naperville-Electric Utility Public Hearing Rules” (the “Rules”), which were adopted by the City of Naperville on December 18, 2012. A copy of the Rules may be obtained at the City of Naperville Municipal Center, 400 S. Eagle St., Naperville, during business hours. A copy of the Rules may also be obtained by visiting www.Naperville.il.us.

In accordance with 16 U.S.C § 2631, the United States Secretary of Energy, any affected electric utility, and any electric consumer of an affected electric utility has a right to intervene and participate as an Interested Party in the proceedings. Please see Rule 1 for the procedure for intervention.

Persons who are not Interested Parties, as defined by Rule 1, will be given the opportunity to make an oral or written statement expressing their position and views on the foregoing federal standards. Please see Rule 2 concerning the procedure for making such statements.

In order for the City of Naperville Electric Utility to fully consider the testimony, evidence and statements presented regarding the federal standards, the following procedural schedule will be utilized:

December 19, 2012 – March 19, 2013: Written Public Comment Period

Members of the general public may submit comments and evidence in writing at any time during the public comment period.

January 18, 2013 – City of Naperville Electric Utility Staff’s evidence and proposed findings will be made available for public review

February 18, 2013 – All Interested Parties must file a Notice of Intervention. See Rule 1.2.

February 25, 2013- A description of the evidence to be presented by any Interested Party must be pre-filed with the City Clerk . See Rule 1.4.

March 4, 2013 – Public Hearing Opens 3:00p.m.-7:00p.m.

March 19, 2013 – Public Hearing Reconvenes 10:00a.m. – 4:00p.m. and closes the proceedings.
