Court Grants State’s Motion to Deny Pre-Trial Release for Elgin Man Accused of Attempt Murder
(The following is a joint release from the Naperville Police Department and the DuPage County State's Attorney's Office.)
DuPage County State’s Attorney Robert Berlin and Naperville Chief of Police Jason Arres announced today that Judge Joshua Dieden has granted the State’s motion to deny pre-trial release for an Elgin man accused of Attempt First Degree Murder. Rocky Ahmedyar, 35 (d.o.b. 3/3/1990) of the 1100 block of Spring Creek Road, appeared in First Appearance Court this afternoon charged with one count of Attempt First Degree Murder (Class X Felony), one count of Aggravated Discharge of a Firearm (Class 1 Felony), one count of Aggravated Stalking (Class 3 Felony) and one count of Misdemeanor Violation of an Order of Protection. Ahmedyar’s wife, the victim in this case, currently has an active domestic violence case and order of protection against him out of Kane County.
On June 17, 2025, at approximately 3:32 a.m., officers with the Naperville Police Department responded to a 911 call placed by the victim who, having moved out of the family home three months ago with their three children, was staying at a residence in Naperville. After speaking with the victim and following an investigation into the matter, it is alleged that at approximately 3:05 a.m., the victim went to her car, which was parked in the driveway of the residence, to leave for work. It is alleged that while at the driver's side of the car, Ahmedyar approached her holding a silver Kimber 9mm handgun in his hand. It is further alleged that Ahmedyar told the victim that she has to talk to him, or he is going to shoot her. It is alleged that after approximately thirty minutes, a car drove by and Ahmedyar lowered the gun, at which time the victim sat inside the driver's seat of her car, placed the car into reverse, and began to slowly reverse. It is further alleged that Ahmedyar walked alongside the vehicle as the victim backed up, held up the gun and told her to stop driving and to listen to him. It is alleged that Ahmedyar then fired a shot at the victim. The bullet went through the top right side of the driver's seat toward the passenger side, missing the victim by millimeters. It is further alleged that after firing the weapon, Ahmedyar fled the scene on foot at which time the victim called 911. At approximately 4:13 a.m., the Elgin Police Department apprehended Ahmedyar as he pulled into his driveway in Elgin. Following further investigation, it is further alleged that Ahmedyar had sent his wife a multitude of harassing and threatening texts including “You watch your self,” “But b**** Iam not scared of your b**** a** I will f*** you up b****,” and “I hope you die one ay b**** because your a virus in the world.” Later that day, with the assistance of the DuPage County Sheriff’s Office K-9 Unit, Naperville police located the gun allegedly used by Ahmedyar.
“Domestic violence is not a private family matter, it is a serious crime that if left unchecked, can escalate causing serious physical harm to the victim, up to and including death,” Berlin said. “While the victim in this case was forced to endure an extremely stressful situation allegedly at the hands of her husband, we are all extremely thankful that she was physically unharmed. I thank the Naperville Police Department for their work on this case and for the quick apprehension of the defendant. I thank the West Chicago and Elgin Police Departments as well as the DuPage County Sheriff’s Office’s K-9 Unit for their assistance. I also thank Assistant State’s Attorneys Anna Derkacz and Helen Kapas for their efforts in securing strong charges against Mr. Ahmedyar.”
“Domestic violence is an incredibly serious and dangerous issue that all too often escalates into violence, like what allegedly occurred in this case. I am grateful that the victim was not physically harmed and I want to commend the quick, coordinated response of our officers, detectives, and the Elgin Police Department, whose teamwork led to the swift arrest of Mr. Ahmedyar,” Arres said “I also appreciate the guidance and partnership of DuPage County State’s Attorney Bob Berlin and his office throughout this investigation. We will continue to work vigilantly to hold offenders accountable and support victims every step of the way.”
Ahmedyar’s next court appearance is scheduled for July 14, 2025, for arraignment in front of Judge Daniel Guerin.
Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
